Terms of Use

The terms and conditions for using Hispanic Heritage Month Maryland.

Effective Date: August 30, 2026

1. Platform and Parties

Hispanic Heritage Month Maryland is a technology platform owned and operated by Marketus Aurelius, LLC ("Marketus"). The Maryland Hispanic Chamber of Commerce ("MDHCC") serves as the licensed program administrator pursuant to a limited-use arrangement with Marketus.

MDHCC's role as program administrator does not transfer ownership of the Platform or its underlying software, systems, workflows, configuration, design implementation, development infrastructure, reusable technical components, or other Marketus technology to MDHCC.

Nothing in these Terms creates a partnership, joint venture, franchise, employment, fiduciary, or agency relationship between Marketus and MDHCC, or between either of them and a user, organizer, sponsor, or event host.

2. Purpose of the Platform

The Platform provides public discovery of Hispanic Heritage Month events and Community Partners across Maryland, together with organizer, administrative, map, calendar, and related features.

The Platform is not a ticketing service, payment processor, event producer, travel service, venue operator, insurer, or guarantor of any listed event. Unless specifically identified otherwise, Marketus and MDHCC are not the organizer of third-party events.

3. Eligibility and Accounts

Public browsing is available without an account. Accounts, organization management, and organizer submission features are intended for users age 18 or older. By creating or using such an account, you represent that you are at least 18 and have authority to act for any organization you represent.

You are responsible for safeguarding login credentials, maintaining accurate account information, and all activity occurring through your account. You may not share privileged administrative credentials or attempt to access roles, records, or functions you are not authorized to use.

4. Event Listings and Reliance

Event information may be submitted by organizers, entered by administrators, or prepared with assistance from public sources and AI-assisted tools. Dates, times, venues, registration requirements, prices, accessibility details, and other information can change.

Before traveling, registering, purchasing a ticket, or making plans, verify material event details with the event organizer or the linked official event page. Marketus and MDHCC do not guarantee that every listing is complete, current, error-free, or available.

5. External Sites and Transactions

The Platform may link to external registration, ticketing, venue, government, school, nonprofit, business, or organizer websites. Those services are independent of the Platform.

Any registration, ticket purchase, payment, donation, refund, cancellation, contract, communication, or dispute that occurs on an external service is between you and the applicable organizer or third party. Marketus and MDHCC are not responsible for third-party sites, products, services, privacy practices, security, or transactions.

6. Intellectual Property and Ownership

Marketus owns and operates the Platform technology. The Platform technology includes, without limitation, Marketus-created source and object code, configuration, architecture, database and information organization, workflows, interfaces, visual and interaction designs, reusable components, development infrastructure, documentation, analytics and administrative frameworks, improvements, names, marks, and branding.

MDHCC retains its rights in its name, trademarks, logos, and content. Organizers and users retain ownership of content they lawfully own and submit, subject to the license granted below. Other licensors and third parties retain their respective rights in content, marks, and other materials. Nothing in these Terms claims ownership of public facts, public-event information, or the independent works of others.

No Platform access, MDHCC administration, sponsorship, submission, or use of the Platform transfers ownership of Marketus technology.

Restrictions. Except where applicable law expressly permits or Marketus provides prior written authorization, you may not: copy, reproduce, modify, distribute, sell, lease, sublicense, white-label, or commercially exploit the Platform technology; reverse engineer, decompile, disassemble, or derive source code from the Platform; circumvent any technical protection measure; make competitive use of non-public Marketus technology or confidential materials; remove, alter, or obscure any proprietary notice; reconstruct the Platform or its database through automated extraction or scraping of non-public data; or use Marketus names, marks, branding, or designs without authorization.

All rights not expressly granted to you in these Terms are reserved by Marketus.

7. License to Use the Platform

Subject to your compliance with these Terms, Marketus grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform for its intended personal and non-commercial discovery, participation, and community purposes. This license terminates automatically if you breach these Terms or your access is suspended or terminated.

8. License for Submitted Content

When you submit event, organization, image, logo, description, or other content, you grant Marketus and MDHCC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, resize, adapt for accessibility or display, distribute, publicly display, link to, archive, and promote that content in connection with Hispanic Heritage Month Maryland, related program communications, reporting, and reasonable promotion of the listed event or organization.

You represent that you have the rights and permissions necessary to grant this license. This license does not transfer ownership of your content.

9. AI-Assisted Features

AI-assisted suggestions may be inaccurate, incomplete, or outdated; they are not legal, medical, financial, safety, accessibility, or other professional advice and require human review before reliance or publication. AI assistance does not create any content ownership or licensing right in favor of any user and does not shift responsibility for the accuracy, lawfulness, or appropriateness of published content away from the organizer or administrator who publishes it. 10. Feedback

If you provide feedback, ideas, or suggestions about the Platform, you grant Marketus a non-exclusive, royalty-free license to use, modify, and implement that feedback without obligation or compensation, to the extent permitted by law and without assigning any separate content rights you do not own.

11. Acceptable Use

You may not use the Platform to violate law, infringe rights, impersonate others, submit knowingly false or deceptive information, transmit malicious code, attempt unauthorized access, disrupt security, scrape or overload the service in a harmful manner, send spam, or use Platform information for unlawful harassment, discrimination, fraud, or abuse.

12. Moderation, Editing, Suspension, and Removal

Marketus and authorized MDHCC administrators may review, edit for formatting or clarity, decline, unpublish, archive, correct, restrict, or remove content or accounts when reasonably necessary to administer the initiative, enforce Platform rules, respond to legal or security concerns, correct material inaccuracies, avoid duplication, or protect users and the public.

Publication or prior approval of an event or organization does not create a permanent right to remain listed.

13. Privacy and MDHCC Data Use

The Privacy & Cookies notice governs Marketus's handling of information through the Platform. Because MDHCC is the licensed program administrator, information may be made available to or received by MDHCC in connection with Platform administration. MDHCC's own handling and use of that information is also governed by the MDHCC Privacy Policy.

Marketus does not sell personal information collected through the Platform. Sponsors do not receive personal information merely because they sponsor the initiative.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM AND ALL PLATFORM CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, OR THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.

Marketus and MDHCC do not warrant or guarantee any event, organizer, venue, external website, registration availability, attendance, safety condition, accommodation, cancellation policy, or outcome.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKETUS, MDHCC, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY; OR DAMAGES ARISING FROM THIRD-PARTY EVENTS, VENUES, ORGANIZERS, LINKS, REGISTRATIONS, PAYMENTS, CANCELLATIONS, TRAVEL, OR USER CONDUCT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKETUS'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU ACTUALLY PAID DIRECTLY TO MARKETUS FOR USE OF THE PLATFORM DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not exclude or limit liability that cannot lawfully be excluded or limited.

16. Indemnification

If you create an account, submit content, or use the Platform on behalf of an organization, you agree, to the extent permitted by law, to defend, indemnify, and hold harmless Marketus and MDHCC and their respective officers, directors, employees, contractors, volunteers, and agents from third-party claims, damages, losses, liabilities, and reasonable costs arising from your unlawful conduct, violation of these Terms, infringement of another party's rights, or content you submit. Organizer-specific obligations are set out in the Organizer Terms & Community Standards.

17. Governing Law and Courts

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles. Any dispute that is not resolved informally will be brought in a court of competent jurisdiction located in Maryland, unless applicable law requires otherwise.

18. Survival; Non-Waiver; Entire Terms

Ownership, intellectual property, the license restrictions, warranty disclaimers, liability limitations, indemnification, and any provisions that by their nature should survive, will survive termination of your access or these Terms. No failure or delay by Marketus or MDHCC in enforcing any right is a waiver of that right, and no single or partial exercise of a right precludes any further exercise of that or any other right.

We may update these Terms from time to time. The revised Terms will be posted with a new effective date. Continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law. If any provision is found unenforceable, the remaining provisions will remain in effect and the unenforceable provision will be enforced to the maximum extent permitted by law.

These Terms, together with the Privacy & Cookies notice, the Organizer Terms & Community Standards, and the Copyright & Takedown notice, form the entire agreement governing your use of the Platform.
