1. Platform Technology and Ownership
The Hispanic Heritage Month Maryland Platform is owned and operated by Marketus Aurelius, LLC ("Marketus"). The Platform technology, including source and object code, configuration, architecture, database and information organization, workflows, interfaces, visual and interaction designs, reusable components, development infrastructure, documentation, analytics and administrative frameworks, improvements, names, marks, and branding, is owned by Marketus and protected by intellectual property laws.
Access to the Platform does not grant any right to copy, reproduce, distribute, reverse engineer, decompile, disassemble, white-label, resell, or create a derivative service from the Platform technology. Automated extraction or scraping of non-public Platform data to reconstruct the Platform or its database is not authorized.
This notice addresses Marketus technology ownership and content-rights concerns. It does not claim ownership of public facts, public-event information, or content and marks owned by MDHCC, organizers, users, licensors, or other third parties. Those rights remain with their respective owners.
2. Reporting a Copyright or Content-Rights Concern
If you believe that content on the Platform infringes a copyright or other content right that you own or control, you may submit a report. To help us review your report promptly and accurately, please include:
Your identity and contact information, including your full name and a working email or postal address;
Identification of the protected work or right you believe is infringed;
The exact Platform URL or location of the material you believe is unauthorized;
A brief explanation of the basis for believing the use is unauthorized;
A statement that you have a good-faith belief that the use is not authorized by the rights holder, its agent, or the law;
A statement, made under penalty of perjury, that the information in your report is accurate and that you are authorized to act for the rights holder; and
A physical or electronic signature of the rights holder or an authorized representative.
3. Review and Removal Process
We will review complete reports and may remove or disable access to clearly infringing material, restrict an account, or take other reasonable action. We may request additional information to verify a report before acting. Submitting a report does not guarantee a particular outcome.
4. Restoration for Mistaken Removal or Misidentification
If material was removed or disabled because of a report and you believe the removal was a mistake or that you have authorization to use the material, you may submit a counter-statement identifying the material, explaining why you believe the removal was mistaken, and including your contact information and a statement under penalty of perjury. We may restore the material after a reasonable review unless we determine that a further restriction is warranted.
5. Repeated Infringement
Where appropriate, we may restrict or terminate the access of users or organizations that are the subject of multiple, substantiated reports of infringing activity, consistent with applicable law.
6. Important Notes
This notice describes a practical review and removal process. Marketus has not filed a federal DMCA designated agent designation, and this notice does not state or imply that one has been filed. This notice does not create a warranty or change the warranty disclaimers or liability limitations in the Terms of Use.
